Margolis</dc:creator></item><item><title>Estate Recovery - Texas</title><link>http://elderlawanswers.com/Forum/Topic77-24-1.aspx</link><description>First, thanks a million for this forum!&lt;/P&gt;&lt;P&gt;On 10/05/01, my mother signed over her real estate (homestead) to me via Warranty/Gift deed (and she retained a life tenancy) .  &lt;/P&gt;&lt;P&gt;I lived her most of the time (09/04-08/06) taking care of her in her home (I maintained a homestead 2 blocks from her home)&lt;/P&gt;&lt;P&gt;On 08/25/06 she entered a nursing home (qualified for Medicaid) and passed away 12/19/07.&lt;/P&gt;&lt;P&gt;I'm an adult (unmarried) child, income above the poverty level, and moved into her home as my primary residence on 05/24/07.&lt;/P&gt;&lt;P&gt;The state is seeking recovery, stating they want the will probated (there are no other assets other than the real estate mentioned above)  and wanted the warranty deed faxed to them.
